On Wednesday afternoon, Homeland Security #KristiNoem [dog killer] was on her way to visit the Terrorism Confinement Center #CECOT in #ElSalvador. She & other officials have touted the #deportations as a feat of #Trump’s agenda to keep Americans safe from violent criminals. Before her arrival she said on her X account she was going to see firsthand “where the worst-of-the-worst criminals are housed.”

Background:

US District Judge Boasberg issued a TRO prohibiting the government from deporting #migrants under the Alien Enemies Act (passed in 1798 as part of the legislative package historians refer to as the Alien & Sedition Acts).

In an extraordinary move (albeit one that this administration is frequently employing), defendants (the government) appealed the TRO. A TRO (temporary restraining order) is normally not appealable.

Result:

Today, a 2-1 ruling by a panel of the US #Court of #Appeals for the District of Columbia slammed the government's case, finding it "unlikely" that the government would prevail in a full hearing on the merits. The court declined to reverse the TRO.

The dissenter is a judge appointed by #RedDon in his first term.

This is all procedural jousting. Though highly consequential, it's preliminary to a hearing and final judgement on the merits of the suit itself.
