Scott 🇮🇱🇺🇦🗽<p>Background:</p><p>US District Judge Boasberg issued a TRO prohibiting the government from deporting <a href="https://babka.social/tags/migrants" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>migrants</span></a> under the Alien Enemies Act (passed in 1798 as part of the legislative package historians refer to as the Alien &amp; Sedition Acts).</p><p>In an extraordinary move (albeit one that this administration is frequently employing), defendants (the government) appealed the TRO. A TRO (temporary restraining order) is normally not appealable. </p><p>Result: </p><p>Today, a 2-1 ruling by a panel of the US <a href="https://babka.social/tags/Court" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>Court</span></a> of <a href="https://babka.social/tags/Appeals" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>Appeals</span></a> for the District of Columbia slammed the government's case, finding it "unlikely" that the government would prevail in a full hearing on the merits. The court declined to reverse the TRO.</p><p>The dissenter is a judge appointed by <a href="https://babka.social/tags/RedDon" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>RedDon</span></a> in his first term. </p><p>This is all procedural jousting.
